Question About The Legality Of Parodies

He who's tired of Weird Al is tired of life.

Okay. There are a lot of dementia artists who do parodies and sell songs on CDs, iTunes, or through their website. And I know they don't pay royalties for them:

Luke Ski
Tony Goldmark
Steve Goodie
Bob Ricci
Sudden Death
Rob Balder
Robert Lund
Carla Ulbrich
Project Sisyphus
Seamonkey

And my band, Nuclear Bubble Wrap.

No royalties, no worries, I think you'll be fine.

If you were to use the exact same lyrics then you would have to pay royalties. Or if you were making a cover then you would. Al also has to pay royalties while making the polkas. Try asking artists on myspace if your really concerned.

Al pays royalties on the parodies for the use of the music. Probably, those other artists get away with paying no royalties because their sales aren't large enough for it to be worth the hassle and uncomplimentary publicity for the copyright holders to come after them. But if one of them suddenly broke out big with another "White & Nerdy" you can bet there'd be a lawyer's letter somewhere in their futures.
"Weird Al" has a charisma that's all his own. The awkward, the misshapen, the socially inept flock to his banner.

Sorry to bump, but...

Since I'm a paranoid little freak, I've email the label again to see what/where they'd want the royalties to go.

If I don't hear back from them, do you think it's OK to proceed?

Go for it. I doubt it would ever be an issue, but if it comes up, you have this topic as proof that you at least made the attempt.
I'm ranking every Beatles song on my new pop culture blog. Check it out!
