Did Al get permission to include Poker Face in this before he seeked permission to parody "Born This Way"? I would think if an album was to include a parody by an artist included in the polka medley he would ask permission for both at the same time.

He had permission to include "Poker Face" well in advance of his asking for permission to do "Perform This Way." Al started recording "Polka Face" on May 8, 2010 (he performed it during the 2010 Tour), while he didn't start recording "Perform This Way" until April 6, 2011.

Getting permission to include songs in the polka is way easier because legally, all you have to do is pay the publishing rights. An artist couldn't really not give permission for it.

Knowing how Al works though, I'm positive if he heard that an artist wasn't really into the idea, he would back off. Actually, that's what happened with Weezer right?

Admittedly the songs chosen brings me back to the more cringe-worthy of pop songs of high school. Bleh to late 2000's-early 2010's pop music! Despite this, Al's Polka style enhances these songs as always. Even if a polka is consists of songs I don't particularly care for, they're always good nonetheless. :P
